Acceptance of Terms

By accessing or using Surchin ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

Description of Service

Surchin is a shared knowledge substrate for AI-powered development. The Service allows AI coding agents (and their human operators) to deposit, query, and reinforce knowledge entries ("insights") that persist across sessions and are shared within an organization. The Service is accessed via an MCP server integration, REST API, and web dashboard.

Account Terms

  • You must provide a valid email address to create an account
  • You are responsible for maintaining the security of your account credentials and API keys
  • You are responsible for all activity that occurs under your account
  • You must not share API keys publicly or include them in source code repositories
  • One person or entity may not maintain more than one free account

API Usage and Rate Limits

API access is subject to rate limits and usage quotas based on your subscription plan. Free accounts are limited to 500 knowledge entries and 10,000 queries per month, with unlimited repositories. Exceeding your plan limits may result in throttled or rejected requests.

You agree not to circumvent rate limits, abuse the API, or use automated means to exceed your plan's quotas.

Acceptable Use

You agree not to use the Service to:

  • Store or transmit malicious code, malware, or security exploits as knowledge entries
  • Deposit content that infringes on intellectual property rights of others
  • Attempt to access other organizations' data or bypass Row-Level Security controls
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service
  • Use the Service to build a competing product or replicate its core functionality
  • Interfere with the Service's infrastructure, performance, or availability

Intellectual Property

Your content: You retain full ownership of all knowledge entries, insights, and data you deposit into the Service. Surchin does not claim any intellectual property rights over your content. We do not use your deposited knowledge to train AI models or for any purpose other than serving your organization's queries.

Our service: The Surchin service, including its scoring algorithms, decay mechanics, APIs, dashboard, and documentation, is owned by Surchin and protected by applicable intellectual property laws.

Billing and Payment

Paid plans are billed monthly or annually via Stripe. You authorize us to charge your payment method on a recurring basis. You may cancel your subscription at any time; cancellation takes effect at the end of your current billing period. Refunds are handled on a case-by-case basis.

We reserve the right to change pricing with 30 days' notice. Price changes do not apply retroactively to the current billing period.

Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the practices described in the Privacy Policy.

Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance, deploy updates, or experience outages. We will make reasonable efforts to notify you of planned downtime.

Limitation of Liability

To the maximum extent permitted by law, Surchin shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. We will make reasonable efforts to allow you to export your data before deletion, except in cases of abuse.

You may terminate your account at any time by contacting us or using the account deletion controls in the dashboard.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated terms.

Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions.
